HB 279 Summary

• Establishes extended producer responsibility (EPR) program requiring packaging producers to register with the Department and participate in producer responsibility organizations to manage their packaging materials.

• Sets escalating reduction targets for non-reusable packaging: 10% reduction after 2 years, 20% after 4 years, 30% after 6 years, and 40% after 8 years from stewardship plan approval.

• Requires minimum recycling rates of 50% after 5 years, 80% after 8 years, and 90% after 12 years, plus minimum postconsumer waste content of 50%, 80%, and 90% at the same intervals.

• Bans manufacture and distribution of packaging materials containing covered toxic substances including PFAS, phthalates, bisphenols, heavy metals, and certain plastics (PVC, polystyrene, polycarbonate), effective October 1, 2025.

• Imposes civil penalties up to $5,000 per violation ($25,000 for hazardous waste violations) and up to $10,000 for repeat offenses, with monthly caps of $200,000.
