State departments, institutions, agencies, community colleges, and local school administrative units must purchase materials and supplies with compostable or recyclable content for food establishments, to the extent economically practicable.

State entities must report annually by October 1 to the Department of Environmental Quality on amounts and types of compostable and recycled content materials purchased and materials collected for recycling.

The North Carolina Policy Collaboratory at UNC-Chapel Hill shall conduct a study on food service ware examining environmental impacts, recycling markets, legislation in other states, and impacts on people with disabilities, reporting findings to the 2024 General Assembly.

The Legislative Services Officer and Department of Natural and Cultural Resources must implement measures to reduce food service ware use in their operations, with preliminary reports due September 1, 2023 and final reports by March 1, 2024.

$50,000 in nonrecurring funds are appropriated to the NC Policy Collaboratory for the 2023-2024 fiscal year to conduct the food service ware study.
