House Bill 358 Summary

• Establishes the "North Carolina Legislative Privacy Act" creating a framework for legislators to request protection of personal information including home addresses, phone numbers, email addresses, financial account numbers, and children's identities under age 18.

• Requires government agencies to remove legislators' personal information from public records within five business days of receiving a written request and exempts the information from future public records requests unless the legislator consents.

• Mandates persons, businesses, and associations remove legislators' personal information from the internet within 72 hours of receiving a written request and prohibits sharing that information with third parties or soliciting it with intent to threaten the legislator's safety.

• Makes it a Class C felony to knowingly post a legislator's personal information on the internet if doing so poses an imminent and serious threat to health and safety and causes bodily injury or death.

• Appropriates $3,300,000 in nonrecurring funds for the 2023-2024 fiscal year to the General Assembly Special Police for security improvements to legislators' residences and district offices, capped at $15,000 per member, effective July 1, 2023.
