House Bill 574 Summary

• Athletic teams in North Carolina middle and high schools must be expressly designated by biological sex (males/men/boys, females/women/girls, or coed) based solely on reproductive biology and genetics at birth.

• Female-designated athletic teams cannot be open to students of the male sex.

• Students deprived of athletic opportunities or harmed by violations may sue for injunctive relief, actual damages including psychological and emotional harm, attorney fees, and costs within two years of the harm.

• Institutions of higher education (UNC schools, community colleges, and private colleges/universities in North Carolina) must follow the same biological sex-designation requirements for intercollegiate athletic teams.

• The State Board of Education and Board of Governors shall monitor schools and institutions for compliance and report violations to the Joint Legislative Education Oversight Committee; law becomes effective for the 2023-2024 school year.
