H596 - Hate Crimes Prevention Act Summary

• Expands hate crime definitions to include offenses motivated by victim's race, ethnicity, color, religion, nationality, country of origin, gender, disability, or sexual orientation, and increases penalties from misdemeanors to Class 1 misdemeanors or Class H felonies depending on offense severity.

• Creates new felony offense of felonious assault as a hate crime (Class F felony, or Class E if death or sexual assault involved) for assaults causing serious bodily injury motivated by protected characteristics.

• Authorizes civil actions by hate crime victims and immediate family members to recover actual damages (including emotional distress), punitive damages, attorney's fees, and litigation costs.

• Requires State Bureau of Investigation to establish a hate crimes statistics database with monthly reporting from law enforcement agencies by the 15th of each month and annual reports to General Assembly by January 15.

• Mandates North Carolina Justice Academy provide law enforcement training and Conference of District Attorneys provide prosecutor training on identifying, responding to, reporting, and prosecuting hate crimes; appropriates $1.89 million for database setup and $530,000 for staffing.
