H 804: Body-Worn Camera Recordings

• Requires most law enforcement officers in counties with populations over 200,000 to wear and activate body-worn cameras during recordable interactions with the public, with exceptions for confidential informants, routine activities, training, private residences without consent, strip searches without consent, and victim/witness interviews without consent.

• Requires law enforcement officers to activate dashboard cameras in law enforcement vehicles during traffic stops, vehicle pursuits, vehicle searches, and other public interactions, with the same exceptions as body-worn cameras.

• Law enforcement agencies must retain original, unredacted recordings for the later of 60 days from recording date, a court order period, or 10 days after an administrative, civil, or criminal proceeding concludes.

• Establishes a $5 million grant program for fiscal years 2023-2024 and 2024-2025 to help law enforcement agencies purchase and maintain body-worn cameras, requiring a 1:5 match of nongrant funds with a maximum grant of $100,000 per agency.

• Modifies access policies for recordings to allow city councils and county boards of commissioners to order release or disclosure of recordings 30 days after creation through public vote, and establishes expedited court review procedures for immediate disclosure requests with a 7-business-day deadline.
