State agencies (excluding UNC Board of Governors and universities) may carry forward utility savings from energy conservation measures to the next fiscal year for additional energy and water efficiency upgrades.

Carried-forward energy savings funds are limited to one-time capital and operating expenditures that create no additional financial obligations on the State.

The Director of the Budget shall not reduce continuation budget requirements for utilities by the amount of energy savings realized, including savings from guaranteed energy savings contracts.

State agencies must submit annual reports on the use of funds authorized under this section to the Department of Environmental Quality.

$100,000 in recurring funds are appropriated to the State Energy Office for fiscal year 2023-2024 to support energy consumption planning by state agencies and higher learning institutions.
