House Bill 87 Summary

• District attorneys may file petitions to reduce, terminate, extend, modify, or revoke probation based on violation of probation conditions, with service to the probationer through the supervising probation officer.

• Indigent probationers are entitled to counsel services when district attorneys file motions to extend probation under this new authority.

• Courts may delegate authority to probation officers to reduce supervised probation terms when offenders are in compliance and demonstrate diligent progress (completion of treatment programs, six months of education or employment, etc.).

• Probation officers may reduce terms by no more than one-fourth of the original supervised probation time, with total reductions across multiple occasions not exceeding one-fourth, and cannot reduce unless all restitution is paid in full.

• Sheriff's offices in 34 specified counties are exempted from state contracting requirements (G.S. 143-129 and 143-131(a)) when contracting for food and food services at detention facilities.
