H870 - ABC Law Omnibus Bill Summary

• Creates a "Bring Your Own Beverage" permit allowing individual patrons to bring malt beverages and unfortified wine to specified establishments (restaurants, breweries, sports venues, private clubs, etc.) with establishment permission; permit fee is $500, effective July 1, 2023.

• Allows mixed beverages permittees to purchase spirituous liquor from any ABC store designated by any local ABC board, rather than a single designated store, expanding purchasing flexibility.

• Authorizes restaurants and bars with mixed beverages permits to sell spirituous liquor with personalized distillery labeling in closed containers for off-premises consumption, limited to three barrels per calendar year.

• Eliminates the physical mixed beverages tax stamp requirement for spirituous liquor sold to mixed beverages permittees, effective December 1, 2023, with compliance tracked through record-keeping instead.

• Permits on-premises ABC permit holders to sell multiple drinks for a single price, establish bundle pricing, and advertise beverage prices on outside signage, effective July 1, 2023.

• Requires the ABC Commission to implement electronic systems by December 31, 2023 for permit applications, order placement, inventory viewing, and fee payment; also directs expansion of cooperative advertising definition.
