Classifies booking photographs as confidential and non-public records under North Carolina law, prohibiting public law enforcement agencies from publishing, distributing, or releasing them.

Permits release of booking photographs only when they are part of a criminal investigation related to a missing person report.

Allows courts of competent jurisdiction to order release of a booking photograph upon a showing that disclosure is actually necessary for immediate law enforcement needs.

Defines "booking photograph" as an image of an individual taken by an arresting public law enforcement agency for identification purposes or taken when the individual was processed into a jail.

Becomes effective October 1, 2023.
