Senate Bill 192 Summary

• Allows expunction of breaking or entering a building with intent to commit felony or larceny and possession of cocaine with intent to sell or deliver.

• Prohibits expunction of any felony offense in Chapter 90 involving fentanyl, replacing the previous prohibition on methamphetamines and heroin expunction.

• Establishes 15-year waiting period for expunction of breaking/entering offenses and cocaine possession with intent to sell charges, compared to 10 years for other nonviolent felonies.

• Clarifies petition denial conditions by adding requirements that petitioners must not be under indictment, have probable cause findings against them for felonies, or be free on bond pending trial for disqualifying crimes.

• Effective December 1, 2023, for petitions filed on or after that date.
