SB 206 Summary

• Creates new criminal violation for possessing, manufacturing, or distributing equipment or materials used to create counterfeit controlled substances, punishable as Class E felony if intentional.

• Expands definition of "opioid antagonist" from naloxone hydrochloride to include all opioid antagonists approved by the FDA for treating drug overdose, and authorizes their use in needle and syringe exchange programs.

• Authorizes pharmacists, pharmacy interns, and pharmacy technicians to administer vaccines recommended by the Advisory Committee on Immunization Practices to persons 18 years and older without requiring specific prescription orders, continuing authorities under expired federal COVID-19 Public Readiness and Emergency Preparedness Act.

• Allows hospitals participating in the Centers for Medicare and Medicaid Services Acute Hospital Care at Home Program to waive compliance with state licensing and certificate of need requirements for home-based care through December 31, 2024.
