Allows property owners in private condemnation proceedings to request court disbursement of all or part of the deposit made by the condemnor when there is no title dispute and the owner does not challenge the condemnor's right to acquire the property.

Permits the deposited money to be paid as full compensation or as a credit against just compensation without prejudice to further proceedings to determine final just compensation.

Judge or clerk may issue orders regarding encumbrances, liens, rents, taxes, assessments, insurance, and other charges as deemed just and equitable.

Requires no notice to the condemnor before hearing on the disbursement application.

Becomes effective October 1, 2023, and applies only to condemnation proceedings initiated on or after that date.
