Commission for Public Health must begin rulemaking by October 15, 2023 to establish maximum contaminant levels (MCLs) for probable or known carcinogens and toxic chemicals posing substantial public health hazards.

MCLs must be established at minimum for PFAS, PFOA, PFOS, hexavalent chromium (chromium-6), and 1,4-Dioxane.

Commission shall consider establishing MCLs for any other contaminants for which at least two other states have set MCLs or issued guidance.

Commission must review MCLs adopted by other states, peer-reviewed science, and Agency for Toxic Substances and Disease Registry materials; state MCLs cannot exceed any MCL or health advisory established by the EPA.

Commission for Public Health shall conduct annual reviews of latest scientific evidence and undertake additional rulemaking as necessary to establish or revise MCLs for contaminants posing substantial public health threats.
