Senate Bill 364 Summary

• Prohibits state agencies and community colleges from requiring job applicants to endorse beliefs or describe actions regarding contemporary political debate or social action as a condition of employment.

• Bars employment applications from inquiring into matters constituting compelled speech, while preserving applicants' voluntary right to speak on any topic.

• Establishes 13 specific concepts that cannot be promoted in state government workplaces or employee training programs, including claims that one race or sex is inherently superior, that individuals are responsible for historical actions of their race or sex, or that meritocracy is inherently racist or sexist.

• Allows private contractors providing training to state employees to respond to questions about prohibited concepts if they clearly state the state government employer does not endorse those concepts.

• Applies to nonexempt state executive branch employees, University of North Carolina employees, Community Colleges System Office employees, and community college employees; effective December 1, 2023.
