DHSR shall issue approval of licensure or provisional licensure when a staffing plan is provided, allowing mental health/IDD/substance use disorder providers to meet other requirements while hiring staff.

DHSR must establish a monthly quality dashboard tracking agency performance metrics including license grant timelines, violation types, penalties, corrective actions, suspensions, revocations, appeals, and OAH case outcomes, with quarterly reporting to the Joint Legislative Oversight Committee on Health and Human Services.

DHSR shall implement enhanced procedural protections for providers including advance notice of required documents, summary of concerns at exit, written reports within 5 business days, 10-day reconsideration reviews for revocation/suspension notices, and required staff training in forensic interviewing techniques.

A new interim reconsideration review process is established before contested case hearings at OAH, with decisions required within 30 days and DHSR bearing all legal fees and costs if a provider successfully contests a DHSR decision.

$100,000 in nonrecurring funds are appropriated to DHSR to implement these changes, which become effective October 1, 2023.
