Limits liability for not-for-profit nongovernmental organizations contracting with the Department of Health and Human Services to provide health care services, preventing them from being held liable for damages caused by public agency negligence.

Prohibits contract provisions that impose liability on nongovernmental organizations for injuries or damages caused by public agency negligence, declaring such provisions void and unenforceable.

Creates limited tort liability for nongovernmental independent contractors providing health care services through public agencies, capping their liability to the same monetary limits as the public agency under G.S. 143-299.2.

Requires the State to indemnify nongovernmental independent contractors for damages exceeding G.S. 143-299.2 limits when claims arise from their provision of health care services.

Becomes effective October 1, 2023, and applies to claims arising from acts or omissions occurring on or after that effective date.
