Senate Bill 76 - Summary

• Adds Section 160A-311.1 to North Carolina General Statutes authorizing cities with populations of 200,000 or greater to implement flood reduction activities within stormwater management programs.

• Allows cities to purchase property for demolishing flood-prone buildings and to undertake improvements to private property including elevating structures, demolishing flood-prone structures, and retrofitting structures.

• Requires city council approval of a policy document establishing minimum standards including private property owner written consent, determination that stormwater system improvements are not cost-effective, and that improvements are the minimum necessary to accomplish stormwater benefits.

• Mandates that city funding provided to property owners above a certain amount must be reimbursed to the city if the property is sold within five years, calculated as the difference between the pre-mitigation fair market value and the sale price, not exceeding total city funding provided.

• Requires an existing stormwater advisory committee to review and approve all flood damage reduction projects and submit annual reports to the city council.
