Durham Public Schools Board of Education and Durham County may enter into partnerships, joint ventures, or land trusts to construct, provide, and maintain affordable rental housing on property owned by either entity.

Both entities are authorized to convey property to these arrangements for housing teachers, sworn law enforcement officers, and first responders employed by local governments in Durham County, with remaining units available to other Durham Public Schools employees.

Durham Public Schools and Durham County cannot transfer property acquired by eminent domain on or after the effective date to the housing partnership.

At least 75% of housing units must be reserved for Durham Public Schools teachers, with rents set at reasonable rates that may be below market rate at the entities' discretion.

Housing units constructed under this act must comply with all applicable building codes, zoning ordinances, and health and safety statutes.
