Adds Section 39 to Article I of the North Carolina Constitution prohibiting the taking of private property by eminent domain except for "public use" and guaranteeing just compensation determined by jury upon request of any party

Places the constitutional amendment on the November 2026 general election ballot for voter approval

Removes "or benefit" from existing eminent domain statutes (G.S. 40A-3), narrowing the standard from "public use or benefit" to "public use" only for all categories of condemnors

Applies to private condemnors (railroads, utilities, pipelines), local governments, and other public entities exercising eminent domain authority

Statutory changes take effect immediately upon enactment; constitutional amendment becomes effective upon certification if approved by voters
