Defendants convicted of felony death by vehicle must pay child support restitution to each minor child of the deceased victim until the child turns 18 and graduates high school

Courts determine payment amounts based on the child's financial needs, standard of living, educational needs, custody arrangements, and the surviving parent's resources and child care expenses

Payments are made through the clerk of court, who must remit funds to the surviving parent or guardian within 10 working days of receipt

Incarcerated defendants have up to one year after release to begin payments, and if arrearage exists when support would normally terminate, payments continue until the full amount is paid

Effective December 1, 2025, applying to offenses committed on or after that date
