Food establishments may not provide single-use foodware (utensils, napkins, straws, condiment packets, cup lids, etc.) unless the customer specifically requests them, applying to dine-in, take-out, and delivery orders

Third-party food delivery platforms must include an option for customers to request single-use foodware rather than automatically including it with orders

Food establishments may still include cup lids, spill plugs, and trays for delivery orders to ensure safe transport, and may offer condiments through refillable single-item dispensers

Violators receive 60 days to correct noncompliance after written notice from the Department; administrative penalties are capped at $100 per day for continued violations

Effective July 1, 2025, and does not preempt local governments from adopting stricter single-use foodware restrictions
