Governor must consult the district executive committee of the vacating district attorney's political party before filling a vacancy and appoint from a list of up to three qualified persons recommended by that committee if provided within 30 days

If the vacating district attorney was unaffiliated or the party committee fails to make a recommendation within 30 days, the Governor may appoint any qualified individual

Only executive committee members who reside within the prosecutorial district may vote on nominee recommendations

Appointees serve until the next General Assembly election held more than 60 days after the vacancy, with election terms varying based on when the original term expires

Effective upon becoming law and applies to vacancies filled on or after that date, with existing vacancies receiving a full 30-day recommendation period from the effective date
