Nongovernmental contractors providing services to minors under contract with DHHS or county public assistance agencies cannot be held liable for injuries caused by the negligence of the public agency or its employees

Contractors remain liable for their own negligence but receive the same monetary damage caps that apply to public agencies under G.S. 143-299.2

Each party (contractor and public agency) must bear its own defense costs for claims arising from its own acts and omissions

Liability protections do not apply to contractors who commit child abuse as defined under G.S. 7B-101(1)

Effective October 1, 2025, applying to claims from acts occurring on or after that date and contracts entered into or renewed on or after that date
