Residents of nursing homes and adult care homes may install electronic monitoring devices (video cameras, audio devices, mobile phones) in their rooms at their own expense, with facilities required to provide power sources, internet access if available, and mounting space

Facilities cannot refuse admission, discharge residents, or include contract provisions waiving rights based on requests to install monitoring devices, and must inform residents of their monitoring rights

Residents must post conspicuous notice on their room door when using monitoring devices and must protect privacy rights of other residents and visitors to the greatest extent possible

Recordings from electronic monitoring devices are admissible as evidence in civil and criminal court proceedings, subject to rules of evidence

Violations by facility operators constitute a Class A1 misdemeanor punishable by up to $2,000 fine and/or one year imprisonment; tampering with or destroying a resident's device carries up to $2,000 fine and/or 90 days imprisonment; effective October 1, 2025
