Health benefit plans covering prescription eye drops must allow early refills for 30-day supplies after 70% of the medication should have been used according to provider instructions, or after 21 days from the original or most recent fill date

Early refill coverage cannot be denied as long as the refill does not exceed the total number of refills authorized by the prescribing provider on the original prescription

Applies to all health benefit plans offered by insurers in North Carolina, as well as the State Health Plan

Appropriates $100,000 in recurring funds from the General Fund to the Department of State Treasurer for each year of the 2025-2027 fiscal biennium to implement State Health Plan coverage

Insurance coverage requirements take effect October 1, 2025, for contracts issued, renewed, or amended on or after that date; State Health Plan coverage applies at the start of the next plan year following that date
