Prohibits individuals who are not legal residents or citizens of the United States or its territories from obtaining expungement of criminal convictions or charges from their records

Requires courts to verify petitioner's legal residency or citizenship status no earlier than 30 days before entering an expunction order, through direct inquiry or document examination

Mandates courts to query Immigration and Customs Enforcement (ICE) if residency or citizenship status cannot be determined through initial verification

Exempts individuals who lawfully entered the U.S. and have filed (or have had filed on their behalf) an immigrant petition with U.S. Immigration and Naturalization Service

Effective October 1, 2025, applying to petitions filed on or after that date
