North Carolina elects to participate in the federal tax credit program under 26 U.S.C. § 25F, allowing individuals to receive federal tax credits for contributions to scholarship granting organizations

The State Education Assistance Authority must certify and submit a list of qualifying scholarship granting organizations to the U.S. Secretary of the Treasury and publish the list on its website

Qualifying scholarship organizations may provide scholarships for elementary or secondary education expenses, including home school expenses, to the extent allowed under federal law

The State Education Assistance Authority must establish necessary rules by July 1, 2026, or within 120 days of federal regulation publication, whichever is later, to ensure state eligibility for taxable years beginning after December 31, 2026

Ratified by the General Assembly on July 31, 2025, and effective upon becoming law
