Creates new permitting framework for upland basins (marinas excavated above the high-water mark accommodating more than 10 vessels) in North Carolina's coastal areas

Requires Division of Water Resources and Division of Coastal Management to approve applications within 60 days unless the Director finds the applicant cannot substantially comply with specified criteria; applications are automatically deemed approved if the Department fails to act within the deadline

Exempts upland basins from stormwater runoff management requirements and allows them to be sited in or adjacent to shellfish harvesting areas, departing from standard marina regulations

Limits coastal wetland impacts to no more than 5% of total upland basin water area and 10% of existing shoreline wetlands, with mitigation required only when entrance/exit areas exceed 125 linear feet

Requires applicants to post bonds or set-aside funds equal to 5 years of estimated operation and maintenance costs for water quality technology, and mandates dissolved oxygen levels equal to or greater than pre-project levels measured 50 feet from basin entrances
