Counties may require developers to post maintenance guarantees for publicly dedicated subdivision roads before transfer to state or municipal maintenance systems

Developers choose the guarantee type: surety bond, letter of credit, or equivalent security from entities authorized to do business in North Carolina

Guarantee amount capped at 20% of the estimated total construction cost for the road, including labor and materials

Roads not accepted into the public roadway system within 4 years of plat recording must be automatically accepted by the administering entity (Board of Transportation or municipality)

Guarantees must be returned within 30 days of road acceptance, with unused funds released to the developer
