Parents of children with disabilities may choose their child's nurse for IEP-required nursing services, provided the nurse previously cared for the child before the IEP requirement or before enrollment at the current school

The parent's chosen nurse must be employed by a nursing agency willing to contract with the local educational agency under standard contract terms, including licensing and liability requirements

The contracted rate for the parent's chosen nurse must be equal to or less than rates paid to other nurses contracted by the school district

Local educational agencies may contract with private special education facilities or service providers for special education and related services, removing the previous limitation that restricted contracting to services public providers were unable to furnish

Effective July 1, 2025, applying to the 2025-2026 school year
