Amends section 15.1-36-01 of the North Dakota Century Code regarding superintendent approval of school construction projects.

Lowers the approval threshold for superintendent review from $41,000 to $25,000 (effective after June 30, 2011).

Requires school districts to demonstrate project need, educational utility, ability to sustain stable or increasing student enrollment for the project's usable life, and financial capacity to pay.

Allows school boards to appeal superintendent denials to the state board of public school education, whose decision is final.

Becomes effective July 1, 2011, and is declared an emergency measure.
