Creates subsection 3 to section 26.1-03-11.1 of the North Dakota Century Code to establish confidentiality protections for actuarial reports, workpapers, and opinion summaries submitted to the Insurance Commissioner.

Designates actuarial certification documents and related materials as confidential and privileged, exempting them from public disclosure under section 44-04-18.

Preserves the authority to subpoena or discover such documents in legal proceedings and permits their use in criminal investigations without limitation.

Allows the Insurance Commissioner to release documents to the actuarial board for counseling and discipline when required for professional disciplinary proceedings, provided the board establishes procedures to preserve confidentiality.

Excludes actuarial opinions required under chapter 26.1-35 from these confidentiality protections.
