Each school district must develop a policy prohibiting student-to-student bullying that includes procedures for reporting, investigating, and disciplinary measures.

School districts must establish procedures for students to report alleged bullying to a designated school employee and for notifying parents of all students involved in confirmed bullying incidents.

"Bullying" is defined as physical acts, verbal utterances, or written/electronic communications directed at a student that causes fear of harm, damages physical or mental health, substantially interferes with academic performance, or prevents participation in school services and activities.

School bullying policies cannot prevent or restrict students, parents, or school officials from directly reporting behavior to law enforcement that violates criminal law under North Dakota Century Code title 12.1.
