Prohibits any person from smoking cigarettes, pipes, cigars, or other combustible materials in a motor vehicle when a child under 13 years of age is present, regardless of whether windows are open or the vehicle is parked.

Requires law enforcement to have a clear and unobstructed view of someone actively smoking to establish probable cause for a violation.

Establishes a $50 statutory fee for smoking violations, compared to the standard $20 maximum for other nonmoving violations.

Specifies that operators' license points cannot be assessed for smoking violations.

Classifies smoking in vehicles with minors as a nonmoving violation subject to the fee schedule in North Dakota Century Code section 39-06.1-06.
