ND HB1165

Creates a new section to North Dakota Century Code chapter 26.1-36 establishing that state residents are not required to obtain or maintain individual health insurance coverage, except as ordered by a court or the Department of Human Services.

Prohibits the state from imposing penalties, assessments, fees, or fines on residents who fail to procure health insurance coverage.

Exempts individuals who voluntarily apply for state-administered Medicaid or Children's Health Insurance Program (CHIP) coverage, students required by higher education institutions to maintain coverage, and individuals required by religious institutions to obtain coverage.

Preserves individuals' rights to voluntarily contract for private health insurance coverage for family members or former family members.
