Creates a new section to North Dakota Century Code chapter 38-01 declaring indemnity agreements in oil and gas production contracts void and unenforceable against public policy.

Voids indemnity provisions that attempt to relieve the indemnitee from liability for their own negligence, their agents' or employees' negligence, or accidents occurring under their direction or supervision.

Defines "agreement pertaining to a well for oil or gas" to include agreements concerning drilling, reworking, repairing, testing, plugging, and other well services, including equipment rental and transportation.

Preserves the validity of insurance contracts and workforce safety and insurance law benefits.

Allows surface estate owners to continue securing indemnity agreements from lessees, operators, contractors, and other persons conducting oil and gas operations on their land.
