Establishes the North Dakota racing commission with a chairman appointed by the governor and four additional members appointed by state chapters or affiliates of horse racing associations (American quarter horse racing, United States trotting, international Arabian horse, and North Dakota thoroughbred owners and breeders).

All commission members serve five-year terms with staggered expiration dates each July first; initial terms are staggered at one, two, three, four, and five years as determined by lot.

Requires commission members to have been state residents for at least two years, maintain good character and reputation, and prohibits those with financial interests in racing from serving or being employed by the commission.

Provides compensation of $75 per day plus mileage and expense reimbursement for commission members.

Declares all unexpired commission terms expired as of June 30, 2011, allowing qualified incumbent members to be reappointed; declares the act an emergency measure.
