Allows public utilities to file applications with the North Dakota Public Service Commission for advance determination of prudence regarding proposed resource additions (energy facilities, transmission facilities, or energy purchase contracts).

Requires public utilities to submit a one hundred twenty-five thousand dollar application fee and cost projections to the date of anticipated commercial operation.

Commission must render a prudence determination order within seven months of receiving the application and must consider benefits of locating facilities within North Dakota.

Approved resource additions are subject to annual reporting requirements until commercial operation and the commission's prudence order is binding for ratemaking purposes.

Creates a rebuttable presumption that resource additions located in North Dakota are prudent, and allows utilities to recover reasonably incurred costs including interest and construction allowances even if the project is discontinued.
