Establishes a statewide definition of "navigable waters" applicable to all state agencies and purposes based on navigability at North Dakota's time of statehood

Defines navigable waters as those used or susceptible to being used in their ordinary condition as highways for commerce with customary modes of water trade and travel

Specifically designates the Missouri River, Yellowstone River, Red River of the North (Wahpeton to Canadian border), Bois de Sioux River (Wahpeton to South Dakota border), James River, Upper Des Lacs Lake, Devils Lake, Painted Woods Lake, and Sweetwater Lake as navigable waters

For navigable rivers, extends the definition of navigable waters to include all waters upstream to the first crossing
