University of North Dakota intercollegiate athletic teams shall be known as the Fighting Sioux and must use the Fighting Sioux logo in use on January 1, 2011.

Neither the university nor the state board of higher education may take any action to discontinue use of the Fighting Sioux nickname or logo.

Any prior actions taken by the state board of higher education and the university to discontinue the Fighting Sioux nickname and logo are preempted and invalidated by this Act.

If the NCAA penalizes the university for using the Fighting Sioux nickname or logo, the attorney general shall consider filing a federal antitrust claim against the NCAA.
