HB 1295 Summary

• Municipalities and governing bodies may not enter agreements with building authorities or other entities that incur debt for property acquisition, improvements, or construction unless approved by at least 60 percent of qualified electors voting on the question, if an election would be required for direct municipal bond issuance.

• City and county governing bodies cannot override this voter approval requirement using home rule authority.

• Buildings for fire, police, or emergency medical services are exempted from the voter approval requirement.

• School boards may not enter building authority agreements for construction, purchase, repair, improvement, modernization, or renovation of school buildings or facilities without approval from the superintendent of public instruction, if such approval would be required if the school district undertook the project directly.
