Lobbyists who lose or destroy their official identification badge may obtain a duplicate by applying to the secretary of state and paying a ten dollar fee.

Lobbyists may wear a reasonable reproduction of the official badge instead of the original, provided it contains the lobbyist's name and registration number, organization name, or the word "lobbyist" in characters no smaller than one-quarter inch.

Violations of lobbyist registration requirements (sections 54-05.1-02 or 54-05.1-03) are classified as infractions rather than class B misdemeanors.

The secretary of state may assess a civil penalty against unregistered lobbyists not to exceed two times the registration fee, following written notice of intent to assess the penalty.

Civil penalties must be assessed and collected before a person is issued a certificate of registration, and may be appealed to district court only on the basis that the secretary of state's determination was clearly erroneous.
