Class D license drivers operating trucks or truck-tractors for hire to transport agricultural products must sign a certification form before being hired confirming they are at least 18 years old and meet specified driving record requirements.

Drivers must certify they have not had a revocation, suspension, or cancellation of driving privileges within three years, do not have pending license actions, have not had drug-related offenses within three years, and do not have pending drug-related actions (with one exception for a single section 39-08-01 violation within three years).

Employers must obtain the signed form, request the driver's record abstract from the department, and verify the information matches the driving record before hiring the driver.

The department shall develop the form with yes/no questions and include a statement of potential penalties for violations.

The section does not apply to drivers hired by grandparents, aunts, uncles, or immediate family members; persons knowingly hiring violating drivers face class B misdemeanor charges, and drivers knowingly violating this section face class A misdemeanor charges.
