HB 1363 Summary

• Modifies grant distribution to tribally controlled community colleges by replacing the fixed rate of $5,304 per full-time equivalent nonbeneficiary student with an amount equivalent to the most recent per student payment under the Tribally Controlled Colleges and Universities Assistance Act of 1978.

• Requires tribally controlled community colleges to submit applications documenting the name, address, and enrollment status of students qualifying for financial assistance.

• Mandates colleges receiving assistance to file reports showing the graduation rate of nonbeneficiary students and the ratio between funding received and the college's annual budget.

• Changes the oil tax revenue threshold transferred to the permanent oil tax trust fund from $700,000 to $1,000,000 from oil produced within the Fort Berthold Reservation boundaries, effective after June 30, 2011.

• Appropriates $1,000,000 from the permanent oil tax trust fund to the State Board of Higher Education for grant assistance to tribally controlled community colleges for the biennium July 1, 2011 through June 30, 2013, with no more than 50 percent expended per year.
