Amends Section 32-12.2-13 of the North Dakota Century Code regarding state indemnification provisions in contracts between the state and political subdivisions.

Prohibits contracts between the state and political subdivisions from containing provisions requiring one party to assume liability of the other party or a third party, or to bear defense costs for actions against the other or third party.

Creates exceptions allowing indemnification provisions in agreements made under joint powers agreements or Chapter 37-17.1.
