State Board of Higher Education shall calculate state funding per student at each institution by dividing total state appropriations by the number of full-time equivalent students enrolled.

State Board shall multiply the per-student state funding amount by the number of full-time equivalent nonresident students at each institution to determine a payback amount.

Students from bordering municipalities in states with tuition reciprocity agreements with North Dakota are excluded from the nonresident student calculation.

Effective starting with the 2011-12 school year and each subsequent year, institutions shall return 50 percent of the calculated nonresident student funding amount to the state general fund for newly enrolled nonresident students.
