HB 1458 Summary

• Establishes an Infrastructure Development Office within the commissioner of the board of university and school lands to manage energy infrastructure development grants and assistance for counties, cities, and townships.

• Creates two new funds (energy infrastructure development fund and energy infrastructure development grant fund) as continuing appropriations to support infrastructure projects affected by oil and gas development, with grants available to counties, cities, townships, school districts, and other political subdivisions.

• Modifies oil and gas gross production tax allocation by redirecting a portion of revenues to the energy infrastructure development grant fund and allocating 15% of certain revenues to the energy infrastructure development fund for county infrastructure needs.

• Appropriates $172.5 million from the general fund (up to $102.5 million by June 30, 2013) to the infrastructure development office for energy infrastructure enhancement, plus $350,000 to update transportation infrastructure recommendations and $100,000 for employment data improvements.

• Sunsets most provisions effective June 30, 2015, except for subsection 6 of section 57-51-15 and the energy infrastructure development fund provisions which expire the same date; declares sections 1, 2, and 5 as emergency measures.
