Public Service Commission shall adopt a unitization formula to proportionately compensate property owners whose wind resources are affected by commercial wind energy conversion facilities.

Total compensation amount for each wind turbine is determined by private negotiations between the property owner and wind developer, with a base payment to the turbine host property and additional compensation for nearby properties with more than minimal wind resource impacts.

Property owners without wind turbines on their land have no rights regarding turbine location or overall compensation unless otherwise provided by law.

Residential property owners without turbines must receive additional compensation for each commercial wind turbine within one-half mile of their residence for audio, visual, and other perceptible impacts.
