Amends section 48-01.2-03 of the North Dakota Century Code regarding public improvement specifications and bidding requirements.

Prohibits governing bodies from requesting bids for articles with specified or copyrighted brand names, single manufacturer products, or patented apparatus when such requirements prevent proper competition.

Allows specification of branded or patented items only if specifications also request bids on other similar articles of equal value, utility, and merit, or unless provided in section 44-08-01.

Passed the Senate 47-0 and the House 89-1 with 4 absent during the 62nd Legislative Assembly (2011).
